Terms and Conditions
CUSTOM ORDERS
To confirm your intention to book your custom order a non-refundable deposit being 50% of the total fee is immediately due and payable to secure your booking. Your booking is not confirmed until Elle-Rose Artist has received your deposit.
The balance of the outstanding fee must be made prior to the date stated on your invoice, which is usually 3 weeks prior to the Event date. Payment is confirmation of your acceptance of these terms and the design discussed. Further changes may incur a fee.
Design meeting - If requested Elle-Rose Artist Founder, Elle-Rose Dunn, will meet with you to confirm the details of your Art. Following on from this a design brief will be sent to you outlining our plans for your artwork. Once the design details have been confirmed by you via, no changes to the Art may be made. Further changes will incur a design fee. Due to the nature of how Elle-Rose Artist creates her work progress shots will not be provided.
Elle-Rose Artist may require you to give her permission to speak with your florist to obtain information and arrange delivery.
Delivery of Flowers - If specific flowers are to be used, they must be delivered fresh within 24 hours of your event, as well as any leftover flowers, to the location confirmed with your Flower Drop booking. No responsibility is taken by Elle-Rose Artist for any damage to the flowers or the arrangement of the flowers that occurs prior to receipt by Elle-Rose Artist.
Images of the fresh flowers as they appeared must also be sent by email elle@elleroseartist.com.au. For our records the Elle-Rose Artist team will also take photos on receipt of the flowers.
Replacement of flowers - If the flowers (or some of them) are not preserved to the satisfaction of the artist, Elle-Rose Artist will replace such flowers with flowers purchased by Elle-Rose Artist so that the arrangement stays substantially the same in appearance. Any replacement flowers will not be charged to you. If, however the flowers provided cannot be preserved due to being in poor condition on receipt Elle-Rose Artist will email or call you to discuss options for their exclusion or replacement at your cost.
Cancellation - If there is a change to the Event date, you must notify Elle-Rose Artist immediately via elle@elleroseartist.com.au.
If the Event is cancelled 3 weeks or more prior to the Event date, Elle-Rose Artist will waive its right to the outstanding balance of the total fees.
If the Event is cancelled less than 3 weeks prior to the Event Date and:
you have already paid for your Art in full, you forfeit all fees paid; or
you have not yet paid all fees for your Art; the balance owing will become immediately due and payable
Our right to cancel your order - In the very, very rare case that Elle-Rose Artist and you have reached a point where we cannot work together, Elle-Rose Artist reserves the right to cancel your booking/order. In the case where cancellation is instigated by Elle-Rose Artist, we will deduct any monies owing for your work done to date and the remainder with be refunded back to you.
Payment - Online payments can be made securely on Xero using PayPal or credit card. You may also pay via direct bank deposit using the details provided on your quote or invoice.
Processing of orders - All orders will be processed on Western Australian business days, which are Monday to Friday, excluding public holidays.
Delivery - We use Australia Post and/or courier for all orders.
All costs associated with the delivery of your order, including insurance, will be payable by you. Such delivery and insurance costs will be determined by the weight of the item ordered and will be calculated as requested, in Australian dollars.
If you live locally to Elle-Rose Artist, you also have the option of picking up the items ordered personally, by appointment.
Elle-Rose Artist accept no liability for items lost in transit.
It is your responsibility to make sure that you provide the correct delivery details. Elle-Rose Artist accept no liability for orders delivered to an incorrect address. If your order is unable to be delivered and is returned to us, we will contact you to arrange re delivery at your cost.
Please note that for both local and international orders paid for using PayPal you do have a degree of buyer protection with regard to items lost in transit. For further information on this refer to the PayPal website. Items paid for via PayPal will be shipped to the address supplied through your PayPal account, so please make sure you have the correct address registered with them.
Refunds and exchanges - Our items come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the items repaired or replaced if the items fail to be of acceptable quality and the failure does not amount to a major failure.
Subject always to Australian Consumer Law, we reserve the right to refuse a refund, exchange or order cancellation; it is assessed at our discretion.
Change of mind - We do not offer refunds, exchanges or allow cancellation of an order if you change your mind.
Artwork Design - We reserve the right for creative control of the artwork that we create for you. If possible
a design consult is preferred to fully discuss the concept of your work and the particulars surrounding your flowers however, it is not necessary and is at the discretion of Elle-Rose Artist and you. Regardless of if you have a design consult or not, your final payment or email agreement is confirmation of the design we discussed.
We endeavour to always create work that resonates with our aesthetic, values and standards. In the very very unlikely instance that we create something for you that you do not love, we will work with you to resolve this, however a remake is almost always required, and this will be at your expense.
Delivery - You will be notified when your Art is ready for delivery. Elle-Rose will attempt to provide the Art to you within 12 weeks of the date of the Event. Some flowers take longer to preserve than anticipated, in which case the date on which the Art will be completed will be delayed.
You may collect the Art from the Elle-Rose studio or it can be delivered to you at your cost, payable in advance.
PRIVATE PURCHASE OF ARTWORK
Cancellation - If your order is cancelled less than 24 hours after sale and:

you have not yet paid all fees for your Art; the balance owing will become immediately due and payable.
Delivery - You may collect the Art from the Elle-Rose Artist studio or it can be delivered to you at your cost, payable in advance.
GENERAL TERMS
Warranties - All pieces of Art are handcrafted and may have flaws. They are unique pieces. No warranty is given that flowers can be perfectly preserved exactly as they appeared originally.
Disclaimers - If the flowers are not delivered within 24 hours of an Event or are in poor condition when delivered, the end results may not be as anticipated. Sometimes flowers do not preserve well or as expected when preserved or placed in resin. This is because they are natural products and all-natural products vary in their quality.
Where a flower is bent or creased by mistake, the resin can move into the plant tissue and create dark transparent patches that often cannot be avoided.
Colours can change slightly when flowers are dried and or placed in resin, so the end product is sometimes not exactly the same as the appearance of the fresh product.
Resin work is all handmade and so may not be exactly square. While all care is taken to ensure that the finished product is as perfect as possible, the pouring process means that sometimes the resin layers might have bubbles in them. The resin may catch dust or other foreign objects and although every effort is made to avoid and or remove them it is not always possible.
Placing the artwork in extreme conditions such as under direct heat, in moist conditions, in the sun could cause deterioration in the artwork. Specifically, the colour in the flowers may fade over time and the glass at the back of the Art may begin to detach itself from the resin.
Some of the resin used is not UV stable. These should be kept out of direct sunlight to avoid a yellowing in the resin.
Elle-Rose Artist accepts no responsibility for flaws in appearance or casting which are a result of the unpredictable performance of flowers or the resin-casting process.
By placing an order for Art, you acknowledge that you understand and accept the risks set out in above and agree to purchase the Art anyway.
